The ministry of society of the army of the workers of Vietnam is working on a draft of the guidance notice on issuing labor licenses for foreigners in Vietnam through the Internet.

According to the draft, the application document for the issuance of a foreign worker's labor license includes an application and document in electronic form and meets the requirements on administrative matters, in line with the regulations on electronic transactions and management of foreign employees working in Vietnam.

Paper attachments shall be converted to electronic form and shall satisfy and reflect the full contents of paper archives. When paper files lose their legal value, the relevant content of electronic transaction data also becomes invalid.

The need to approve the recruitment of foreign staff

Draft content shows that at least ten days before the hire foreign employees expected, the employer (in addition to the contractor) has an obligation in accordance with 11/2016 / N Đ - CP agreed the provisions of article 4 through http://dvc.vieclamvietnam.gov.vn, submit to the license to labor agencies employ foreign staff demand report.

Within ten days of receipt of a statement or change in employment requirements, the Labour licensing authority will transmit the results to the employer through the email address indicated on the electronic application form.

If the report does not meet the requirements, the issuing agency will send an E-mail to the employer to make amendments and supplementary comments.

If the report is qualified, the employer shall submit the legal version of the explanation report or the change of employment requirements of the employee to the labor license issuing agency for comparison with the electronic file before obtaining the approval result of hiring foreign employees. The employer may obtain the approval directly from the issuing authority or by post.

Issue of work permit

At least at the beginning of the foreign employees working for the employer's ten days before the expected, the employer shall, in accordance with 11/2016 / N Đ - CP agreed the provisions of article 10 through http://dvc.vieclamvietnam.gov.vn, submit an application to the license to labor agency work license file.

Within five working days from receipt of the full file, the Labour licensing authority will transmit the results to the employer through the email address provided on the electronic application form.

If the application file is not qualified, the labor license issuing agency proposes to the employer through E-mail to make amendments and supplement to improve the file.

If the application file is qualified, the employer shall submit the original version of the application file to the labor license issuing agency for comparison with the electronic file before obtaining the result of the labor license issuance. The employer may collect the permit directly from the issuing authority or by post.
